Terms of service

The purpose of these terms of service of use (the “TOS”) is to provide a legal framework for QualFlo’s provision of the site and services and to define the conditions of access and use of the services by the “User”.

These TOS are accessible on the site under the heading “TOS”.

Any registration or use of the site implies the User’s acceptance without any reserve or restriction of these TOS. When subscribing to the “Solo” plan, each user expressly accepts these TOS by ticking the box preceding the following text: “I acknowledge that I have read and understood the TOS and I accept them”.

In the event of non-acceptance of the Terms of service stipulated in this contract, the User must renounce access to the services offered by the site.

https://www.qualflo.com reserves the right to unilaterally modify the content of these TOS at any time.

2 : Access to the website

The website https://www.qualflo.com provides the User with access to the following services:

– consult QualFlo’s offer and other information potentially useful to interested parties
– the possibility for interested parties to contact QualFlo staff members

– The app.qualflo.com sub-domain is used to access QualFlo’s web application for users who have subscribed to an offer.

Apart from the app.qualflo.com sub-domain, the website is accessible free of charge from any location to any User with Internet access. All costs incurred by the User to access the service (computer hardware, software, Internet connection, etc.) are at the User’s expense.

Non-member Users do not have access to the reserved services (the web application). To do so, they must either register by subscribing to the “Solo” offer, or activate their account after their company has subscribed to one of our offers. By agreeing to register for the reserved services, the User-member commits to providing true and accurate information concerning their civil status and contact details, in particular their email address.

To access the services, the User must then identify themself using their login and password. This password must meet certain criteria in order to contribute to the security of the account.

Any User who is a regularly registered member may also request to unsubscribe by going to the dedicated page on their personal space. This will be effective within a reasonable period of time.

Any event due to a case of force majeure resulting in a malfunction of the site or server and subject to any interruption or modification in case of maintenance, does not engage the responsibility of https://www.qualflo.com. In these cases, the User thus agrees not to hold the publisher liable for any interruption or suspension of service, even without prior notice.

The User may contact the administrators of the website by email at the email address of the editor provided in part 1.

4 : Intellectual property

The brands, logos, signs as well as all the contents of the site (texts, images, sound…) are protected by the Intellectual Property Code and more particularly by copyright.

The QualFlo brand is a registered trademark of JONES Alexander. Any representation and/or reproduction and/or partial or total exploitation of this brand, of any nature whatsoever, is totally prohibited.

The User must request prior authorisation from the site for any reproduction, publication or copy of the various contents. He or she undertakes to use the contents of the site in a strictly private context; any use for commercial and advertising purposes is strictly forbidden.

Any total or partial representation of this website by any process whatsoever, without the express authorisation of the website operator, would constitute an infringement punishable by article L 335-2 and following of the French Intellectual Property Code.

In application of article L122-5 of the Intellectual Property Code, Users who reproduce, copy or publish the protected content are reminded that they must cite the author and its source.

6 : Hypertext links

Hypertext links may be present on the site. The User is informed that by clicking on these links, he or she will leave the https://www.qualflo.com website. The latter has no control over the web pages to which these links lead and cannot, under any circumstances, be held responsible for their content.

Ce dernier n’a pas de contrôle sur les pages web sur lesquelles aboutissent ces liens et ne saurait, en aucun cas, être responsable de leur contenu.

8 : Applicable law and jurisdiction

French law applies to this contract. In the absence of an amicable resolution of a dispute between the parties, the French courts will have sole jurisdiction to hear it.
